By accessing this Site and subscribing to the services offered, You agree to be bound by these terms of use. If You do not agree with any part of these terms, please do not subscribe to the services offered by this site.

1. Definitions

“OCTC” as referred to thereafter means Oxford Health NHS Foundation Trust, Warneford Hospital, Warneford Lane, Headington, Oxford, OX3 7JX. England.

“You” and “Your” means you the person entering into this agreement with OCTC

2. User Obligations

1. You agree that You will only access and use the Site in accordance with these terms of use and in accordance with and subject at all times to all applicable laws and regulations anywhere subsisting in the world.
2. You will not directly or indirectly act or omit to act in any way which may infringe, damage or endanger any intellectual property rights (or any goodwill attaching thereto) of OCTC or any third party which may now or in the future subsist in any part of the world and will not knowingly permit any other person to do so.
3. You will provide OCTC with accurate personal details as requested by us upon registration (where necessary) including Your full name and address and will inform us immediately of any changes to the information that You provided when registering.
4. You are responsible for maintaining the confidentiality of Your account and password and You agree to accept responsibility for all activities that occur under Your account or password.
5. You may not in any circumstances do any of the following on or in relation to the Site:
a) involve the transfer or use of any computer viruses, trojan horses, worms or anything else designed or intended to interfere with or interrupt or disrupt any computer or other systems or to secretly or covertly access, use or appropriate any data or other information or impair the functionality, interoperability or performance of this Site;
b) be offensive, menacing, abusive, defamatory, obscene, indecent or pornographic;
c) impersonate any person or entity or falsely state or otherwise misrepresent Your affiliation with a person or entity;
d) create any liability for OCTC whatsoever;
e) permit any third party to do any of the above.

3. Intellectual Property

All contents on this Site (including text, graphics and any other material) are protected by copyright, trade marks and other intellectual property rights which are owned or controlled by OCTC or our licensees. You agree to comply with all copyright notices, information or restrictions contained in any information accessed through this Site.

You may use the Site solely for Your own personal use. Under no circumstances are You permitted to publish, re-transmit, re-distribute or otherwise re-produce any of the content supplied to You or which appears on the Site in any format to anyone and You may not use any such content in connection with any business or commercial enterprise.
You agree not to copy, modify, adapt, reproduce, translate, distribute, transmit, reverse engineer, frame, “scrape” data, decompile or dissemble any aspect of this Site (including, but not limited to, prices and product descriptions or images) with the following exception: Where the site expressly permits You to do so, You may print and store one electronic copy of content provided by this Site for Your personal use provided that (a) You do not alter or modify any of the content, (b) You do not use any pictures or other content separately from its context in this Site and (c) You acknowledge the intellectual property and other rights OCTC and other third parties may have in this Site when producing copies.
The products, processes, software and other technology described in this Site may be the subject of patents and/or other intellectual property rights owned by OCTC or third parties.

4. Privacy

OCTC is fully committed to ensuring full compliance with all aspects of the Data Protection Act 1998 and only keeps information about Site users that is required to process orders and provide an appropriate informative service.

You have a right to view, amend and delete any personal data of Your own that may be retained by OCTC. If You wish to do so, please contact OCTC by email at octcsupport@oxfordhealth.nhs.uk or at OCTC’s registered address.

OCTC may share visitor trends and other generic information collected on this Site with third parties but will not pass on any personal details or personally identifiable information without Your specific consent.

Under no circumstances does OCTC hold sensitive payment details such as credit card numbers. All payment transactions are handled through the accredited payment bureau, Stripe. For more information please visit Stripe’s privacy policy.

5. Security

All payment transactions are handled through Stripe (please see above website for details of encryption they operate). Please note that OCTC’s site does encrypt any data You may forward to it’s site. Therefore information submitted to OCTC over this Site is normally protected.

6. Force Majeure

You expressly absolve and release OCTC from any claim of harm resulting from a cause beyond OCTC’s control, including, but not limited to, the failure of electronic or mechanical equipment or communication lines, telephone or other interconnect problems, computer viruses, unauthorized access, theft, operator errors, severe weather, earthquakes, or natural disasters, strikes or other labour problems, wars, terrorism, or governmental restrictions.

All links from this Site are provided for information and convenience only. OCTC cannot be held responsible for sites linked to, or the material found there or for any error, omission or inaccuracy in such material or its failure to comply with the relevant laws or regulations. We cannot guarantee that these links will work all of the time and we have no control over the availability of the linked pages. Any dealings You have with third parties via the Site are Your responsibility and we will not be responsible for any loss or damage suffered as a result.

OCTC makes no representation that any information, product or service referred to in the materials on this Site are appropriate for use, or available, in other locations. OCTC may revise the terms of use at any time by altering this posting. Therefore You are advised to check these terms regularly to confirm You are willing to continue to be bound by them.

10. Variation of content of the Site

OCTC reserves the right at any time and without notice to remove, amend or vary any of the content which appears on any page of the Site.

11. Severability

If any part of these terms and conditions is determined to be invalid or unenforceable that will not affect the viability and enforceability of any remaining conditions.

12. Waiver

A failure by OCTC to exercise or enforce any rights under these terms shall not be deemed to be a waiver of any such rights or operate so as to bar the exercise or enforcement thereof at any subsequent time or times.

13. Term and Termination

OCTC reserves the right to deny access to certain customers where exclusive arrangements with other parties are in place, and or if pre-requisite courses have not been taken. In addition OCTC reserves the right to terminate access or deny future access if there is evidence that the terms and conditions of the site are not being adhered to (e.g., sharing account details or website materials).

14. Entire Agreement

Save in case of fraudulent misrepresentation or fraudulent concealment, these terms and conditions set out the whole of the Agreement relating to use of and access to the Site. They may not be varied by You at any time.

15. Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with English law. Disputes arising in connection with this Agreement shall be subject to the exclusive jurisdiction of the English courts.

16. Refunds

We hope that you will be delighted with your OCTC experience. However we appreciate that occasionally there may be reasons why you may choose to cancel your online training access where you have paid in advance or perhaps for technology reasons we are unable to provide you with purchased items. If for any reason you are unhappy with your purchase, you can contact our on line help desk where you will be advised of any refunds due.

By law, customers in the European Union have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered. This applies to all of our products except for digital items and services (e.g.: Online Training) where the online service has been accessed. We regret that we also cannot accept cancellations of contracts for the purchase of video, DVD, audio, products and software products where the item has been unsealed.

We reserve the right to refuse returns or to charge you our fees and expenses if the product is received otherwise than in accordance with these requirements.

Training terms and conditions:

Confidentiality

Workshops often contain clinical material. This is always anonymised as far as possible but workshop attendees are none the less reminded to respect confidentiality.

Making reservations

Bookings for places on a workshop can only be considered confirmed after we have received your application form and payment (or invoicing details, including an official purchase order and the relevant trust identification/provider code, where applicable). Please note that registration for all workshops closes 7 days prior to the workshop.

Cancellation & changes policy

If you cancel a workshop booking more than 14 days prior to your booked event, we will refund your fee minus a charge of 15% to cover our administration costs. We regret that cancellations 14 days or less before the booked event cannot be refunded.

If you wish to change your booking after confirmation we will do our best to accommodate you if you notify us 14 days prior to your booked event, and if there is space to do so. However there will be an administration charge of £15 per change.

For commissioned workshops (i.e., away from OCTC premises)

If you cancel all or part of the commission more than 8 weeks from the scheduled start of the training, the relevant fees will be cancelled (or refunded if already paid); if you cancel between 8 and 4 weeks from the scheduled teaching date, 50% of the agreed fees must be paid; cancellation less than 4 weeks from the scheduled start date will mean payment of the full teaching agreed fee.

If an OCTC presenter has to cancel, we will attempt to find an alternative presenter or date that is acceptable to you. If we cannot find acceptable alternatives, then the relevant part of the agreed fees will be cancelled or refunded.

For clinical services (CBT assessment and treatment sessions) if the scheduled session is cancelled more than 24 hours before its scheduled start then the fee is waived; if the session is cancelled at less than 24 hours before its scheduled start then 50% of the fee must be paid. The full fee will be charged for any sessions that are not attended without any notice of cancellation being given.
